We have just had a call from our conveyancers, and the sellers solicitor has advised that Westpac cannot find a copy of the Certificate of Title, which is required before settlement can happen. Of all the incompetent unprofessional morons. A week to go before settlement, and they only now find out that the bank doesn’t have the title. What were they doing for the past 2 months?
All the funds have been in the trust account for a week now, the movers come on Monday for the uplift, we have non-refundable tickets on the ferry, and now we may not have a place to live when we get to Tasmania.
If the title can’t be found, the bank will have to request a new one from the State Revenue Office, then it has to be advertised in the newspaper for up to two weeks in case someone has a claim on it. That would mean we would have to pay for storage on our container in Launceston, try to find some short term rental, etc. We also have to organise mail redirection, so we will get a P.O. box at the Legana Post Office set up.
The conveyancers say that there is a good chance we can get early access to the property, even paying rent for a couple of weeks. Apparently it’s is fairly common in Tasmania for the title to be missing due to state bank consolidations in the late 1990’s. Getting early access to a property is also a regular occurrence but it is up to the sellers. It would be nice to know we have that option.

Apparently they have heard too many “horror stories” about things going wrong with this type of arrangement. These are people who have a satellite dish on the roof to pick up Christian broadcasting.
Needless to say we are quite pissed off by this news, but there is nothing we can do now. Maybe the bank will find the title in time. All we can do is carry on, look into the cost of storing the container and the loaded station wagon over there . Maybe we can take a trip down to Hobart and a few other places.
